    What happens if you get divorced in Turkey?

    I recently covered how to get married in Turkey. It is time to cover the other side of marriage: Divorce. Like any other person going through a divorce, you might wonder that what happens to your stuff, how you should divide them and what the law says. Today, I'm gonna cover what happens if you get divorced in Turkey.

    Can you get remarried in Turkey?
    Marriage laws mostly concern your own national laws. Therefore, if you are eligible to marry and remarry in your own country, you can do so in Turkey as well. But, if Turkish law is to be taken into consideration, for women that is, You have to wait 300 days after your divorce to be able to remarry. There is an exception to this rule however. If you can prove you are not pregnant or you wanna remarry your ex for some reason, you can remarry sooner than 300 days. Of course, if you are pregnant and give birth during the waiting period, you can remarry after giving birth. This was all for women, men on the other hand, can remarry like bunnies I guess.

    What happens to your assets if you get divorced in Turkey?
    Any property acquired during the marriage ,by either spouse, is considered as Matrimonial Property and thus subject to sharing agreements during a divorce. You can decide at the time of marriage to either have the habitual residence or the national law govern your divorce proceedings. IF no such choice has been made, the common national law of the spouses at the time of marriage, or in the absence of common law, the internal law of their habitual residence at the time of marriage shall govern or in the absence thereof, the Turkish law shall govern!

    Different types of matrimonial property agreements in Turkey:
    • participation in acquisitions (property acquired during marriage)
    • separation of property
    • separation of property with distribution
    • community of property
    What are the exceptions to participation in acquisitions?
    1. personal belongings used by just one spouse
    2. assets belonging to just one spouse at the beginning of the marriage, acquired without consideration, or acquired free-of-charge
    3. compensation for pain and suffering
    4. substitute values of pre-existing personal properties.
    You are not required to divide these properties when you get divorced.

    What happens to your house if you get divorced in Turkey?
    This is an important question! What happens to your house if you get divorced in Turkey has a very simple answer: The judge will decide! The judge will decide who gets the house and who gets the furniture.
