    How to get a work permit in Turkey 2023

    The process of obtaining a work permit in Turkey can be confusing due to bureaucratic procedures and inconsistent information. This article aims to provide clarity on the relevant regulations and application process for most foreign individuals, excluding those under temporary protection. The International Workforce Law No.6735, effective since August 13, 2016, governs work permit requests, replacing the previous Law on Work Permits of Foreigners.

    It's important to note that working without a work permit in Turkey is generally prohibited unless exceptions exist within laws, agreements, or conventions. For instance, Turkish citizens who intentionally renounce citizenship under Article 28 of the Turkish Citizenship Law No.5901 can still work. Otherwise, both employers and foreigners working without a permit face fines and potential deportation.

    Special Direct Foreign Investments also offer work permit options, subject to specific criteria such as minimum capital and turnover. Certain professions, including lawyers, notary publics, and pharmacists, are ineligible for work permits.

    The Law applies to various categories, including current workers, vocational trainees, interns, cross-border service providers, and employers of foreign workers. Managing partners of certain companies and executive board members need work permits too.

    Despite misconceptions, many foreigners are unaware of the work permit requirement. Exemptions include cases specified in Article 55 of the Application Regulations of Law On The Work Permit For Foreigners, such as individuals covered by bilateral agreements or approved by sports organizations.

    Applying for a work permit in Turkey necessitates employer sponsorship. Applications are submitted through the Ministry's online system ("e-devlet"). Required documents, such as residence permits and employer information, are uploaded. The completed application form, signed by both employer and employee, must be sent to the Ministry along with hard copies within six working days.

    Commonly required documents include a valid residence permit, passport, photo, foreigner's ID number, a work permit request petition, employer's trade registry copy, and tax registration certificate. Diplomas and certifications related to the job might be needed. Additional supporting documents may be required based on individual circumstances.

    Pre-authorization is mandatory for certain fields like health and education. Evaluation criteria include the employer having a minimum of five Turkish employees, specified capital or sales figures, and certain share ownership conditions.

    After submission, the Ministry evaluates applications within 30 days, but processing might take longer. You'll receive an email notifying you of the result. If approved, payment details for fees are provided, and the work permit is sent upon payment. Rejected applicants can object within 30 days, and further legal action is possible if necessary.

    Work permits grants residence permits as well. Holders need to join the social security system within 30 days of the work permit's start. Work permits are typically granted for one, two, or three years, depending on various factors. Applications for extensions should be filed 60 days before the current permit expires.

    Aside from temporary work permits, other options include permanent work permits, independent work permits, and the Turquoise Card, which offers permanent work rights. Foreign students can apply for part-time work permits during their studies, with different rules for different degree levels.
