    What are the Laws of renting a house in Turkey?

    You can get a 1 year residence permit in Turkey by renting a house. You can extend your residence permit by renting a house as well for as long as you wish to stay in Turkey. So, here are some laws of renting a house in Turkey that you should know.

    Lease arrangements:
    In Turkey, the lease is drawn by agreement between the two parties, which is signed by the parties by arranging a lease in real estate agency.
    It is advisable to arrange your lease in a reputable real estate company. If you are not fluent in Turkish, hire a translator to help you with the process.
    The real estate agencies will take a commission fee to draw the lease agreement. This fee is usually 12 or 13 percent of the annual rent, or same as a month of rent.
    You can rent a furnished or unfurnished place in Turkey.
    According to the laws of renting a house in Turkey, you must have a valid passport or a residence card (Kimlik).

    Things that need to be mentioned in the lease:
    • The exact address of the property being traded
    • The type of property rent (commercial, residential, etc.)
    • Details of the landlord info (name, national number, exact home address, etc.)
    • Details of the tenant info (name, passport number or TC residence card)
    • Date of contract
    • Mention of the household items and the condition of each
    Terms and conditions of rent

    In Turkey, the rent of a property must be paid at the beginning of each month.
    According to Laws of renting a house in Turkey, a security deposit is taken from the tenant equal to two months' rent.
    Therefore, at the beginning of the lease, the rent is paid to the landlord for three months. So, you'll be paying 3 months rent in the beginning of contract.
    Payment of maintenance bills (Aidat) must be made by the tenant.
    The names of all the people living in the rented property who are over 18 years old must be mentioned in the contract.


    Lease extension

    • In case of renewal of the lease according to Laws of renting a house in Turkey and with the agreement of the parties, the amount equal to 19.60% of the lease will be added to the rent (January 2022).
    This amount (tüfe) is announced by the government every month based on inflation rate.

    • If your landlord did not contact you on the renewal date, you can assume that the tüfe announced by the government is added to your rent and that is your new rent.


    Important Notes

    • All lease terms must be recorded in writing in the lease, otherwise they have no legal value.
    Note: Even if the landlord is a trusted person and someone close to you, do not forget to keep your agreements in the form of email, voice or text that can be used somewhere so that you can use it if needed.

    • The landlord is obliged to repair the house furniture and appliances before the tenant moves in and the house should be without any problems. On the other hand, the tenant is obliged to return the house and furniture as received and mentioned in the lease. If something is damaged during your stay, you are obliged to repair it yourself.

    • If either party cancels the lease earlier than the deadline, they are obliged to notify you two months in advance. If the cancellation is from the tenant, the deposit will usually not be refunded.

    • According to the law, the landlord can not cancel the lease ahead of time without a reasonable and justified reason unless the tenant is causing troubles. For example, does not pay the monthly charge or rent on time Or neighbors have complained about the noise, harassment etc..

    • If the landlord declares that he has sold the house, the tenant can stay in that house until the end of the contract and in no way can the tenant be forced to leave. From the time of announcing the sale of the house, the landlord is obliged to give the tenant 90 days to vacate.

    • If the tenant rents a house for 1 year and for some reason wants to move earlier than 1 year, he can notify the landlord 2 months in advance and usually the landlord agrees in this situation because it can be in his favor and they can rent the property at a higher price, but until he finds a new tenant, he can claim the rent for the remaining months, unless you come to an agreement otherwise.

    according to Laws of renting a house in Turkey subletting is illegal! However, if your landlord agrees you can sublet your place. If you sublet the place, the new tenants are responsible for the place.


    A tenant is very well protected by the Laws of renting a house in Turkey.
