    how much can your landlord increase your rent in Turkey 2022?

    With inflation ravaging Turkey without a water break, we have been seeing random rent increases by landlords all over specially in the bigger cities. But how much can your landlord increase your rent legally in Turkey?

    Your rent is determined when you draw up your lease for either 1 or 2 years. After your lease is up, by law, there is a limit on how much your rent can be increased. This has lead to many landlord kicking out their old tenants just so they can charge how ever much they please with a brand new tenant.

    According to the Article 344 of the Law of Obligations No. 6098 (“Law of Obligation”), the agreement between parties with regard to increase in rent in a renewed rental period is valid so long as the rate of increase does not exceed last rental year’s (previous rental period) 12-month average of Consumer Price Index (AKA “TÜFE” in Turkish). TÜFE is announced by Turkish statistical institute every year and you can check it out for your self with this link: https://www.tuik.gov.tr/

    Beware that if you draw up your lease using USD, it can not be changed to Lira or any other currency for 5 years!

    This year, as of June 8th 2022, the cap for rent increase based on the previous year is 25%! This rent increase cap will stay in effect until June 1st 2023.

    What happens if your landlord increase the rent above the 25% in 2022?
    Good news is that the increase above this percentage, even if you have been notified beforehand, is ILLEGAL! and you can keep paying your rent as per previous agreement and the landlord can not evict you.

    Can the landlord sue you into paying more?
    Well, yes and no! if it is within 30 days of your renewal contract, then yes. if its been longer? then no. specially if there has been no agreement with the parties beforehand.
